Fight Leads To Riot Charges For Three

On 10.18.2017 at approximately 7:24 pm, officers from the Milford Police, Milton Police, and Rehoboth Police assigned to the downtown area for a parade detail responded to a parking lot in the 100 block of South Walnut Street to a fight.  Upon arrival one of the two parties fighting fled as officers attempted to make contact with the other.  As the officers made contact with Constance Mack, 30 of Milford, two other individuals intervened with officers who were attempted to resolve the issue.  Joshua A. Johnson, 20 of Greenwood, and Tyquine Green, 18 of Ellendale both continued to be disorderly and uncooperative with officers after being given commands to cease their behavior.  Mr. Green and Mr. Johnson both struck officers as they were attempting to take them into custody.  Both were eventually taken into custody by officers on the scene.  Oleoresin capsicum spray was deployed by an officer as part of this arrest.  An Axon Body Worn Camera assigned to an officer on the scene was also damaged by Mr. Johnson during this incident.  The actual cause of the initial altercation is still under investigation as individuals with knowledge about the incident fled as officers were attempting to control the situation.    Ms. Mack has been charged with Riot and Disorderly Conduct.  Ms. Mack was presented at the Justice of the Peace Court #3, where bail was set at $3500.00 unsecured.  Ms. Mack was also found to have and active capias out of the Justice of the Court #3.  Mr. Johnson was charged with Riot, Resisting Arrest, two counts of Offensive Touching of a Law Enforcement Officer, Criminal Mischief, and Disorderly Conduct.  Mr. Johnson was presented at the Justice of the Peace Court #3, where bail was set at $3000.00 cash.  Mr. Johnson was committed to the custody of the Delaware Department of Correction at the Sussex Correctional Institution.  Mr. Green has been charged with Riot, Resisting Arrest, two counts of Offensive Touching of a Law Enforcement Officer, and Disorderly Conduct.  Mr. Green was presented at the Justice of the Peace Court #3, where bail was set at $6000.00 unsecured.  All three are scheduled for Preliminary Hearings at the Sussex County Court of Common Pleas on 10.26.2017.  Updated photos for Mr. Green and Ms. Mack were not available at the time of this release.
