On 03/10/2018 at approximately 12:02 p.m., the Milford Police Department Patrol Division responded to Walmart located at 939 N DuPont Blvd. Milford, DE, reference to a trespassing investigation. Officers made contact with asset protection staff, who advised that a suspect by the name of James Gowens, 49 of Milford, DE, was currently in the store but had been banned from Walmart due to previous investigations at other Walmart stores in Delaware. Contact was made with Gowens and he was taken into custody. Investigation also revealed that Gowens had shoplifted from the store on two recent occasions. Investigation showed that during the first incident, Gowens allegedly removed merchandise from shelf and then shoplifted the merchandise by exiting the store through an emergency exit which activated an audible alarm. This alarm caused alarm to patrons and employees of the store until the alarm could be deactivated. During the second incident, Gowens entered into Walmart with an unknown subject and allegedly removed merchandise from the shelf and then shoplifted the merchandise by exiting the store through the emergency exit which activated an audible alarm. This alarm again caused alarm to patrons and employees of the store until the alarm could be deactivated.
Gowens was charged with Conspiracy 3rd Degree, two counts of Shoplifting Under $1500, two counts of Disorderly Conduct, and three counts of Trespassing 2nd Degree. Gowens had a presentment through Justice of the Peace Court 7 and was committed to the Department of Corrections in default of $3500.00 USC secured bail. A no contact order was also issued between Gowens and Walmart. Gowens was ordered to appear in Kent County Court of Common Pleas at a later date reference to this investigation.
