Dover Man Charged Following Incident In Restaurant

Location Of Incident: Popeye’s, 600 block of North DuPont Boulevard (US Rt 113)

On 06.22.2018 officers from the Milford Police Department’s Patrol Division responded to Popeye’s in the 600 block of North DuPont Boulevard (US Rt 113) to a report of a disorderly individual.  Upon arrival officers contacted Charles H. Benson, 58 of Dover.  The responding officers made multiple request for Mr. Benson to leave the store and he failed to comply, including the fact that he could be arrested.  Mr. Benson failed to comply with officers request and officers eventually attempted to take him into custody.  Mr. Benson resisted officers and a struggle ensued.  Officers were eventually able to take Mr. Benson into custody.  Mr. Benson has been charged with Resisting Arrest, Disorderly Conduct, and Trespass 3rd Degree.  Mr. Benson was presented at the Justice of the Peace Court #2, where bail was set at $700.00 unsecured, along with being ordered to have no contact with the restaurant.  Mr. Benson is scheduled to appear at the Kent County Court of Common Pleas on 09.05.2018 for an arraignment.
